Litigation in Spain

Unfortunately, the business world is not without some degree of conflict that can be burdensome if not managed in the right way. It is important to have fast and appropriate advice in order to reach an amicable settlement of the dispute. Sometimes the judicial process is inevitable and then specialized care is even more essential. We offer a comprehensive service in this field through friendly negotiation, alternative dispute resolution (ADR), and litigation.

In Spain as elsewhere, it is crucial to find a lawyer who you can work with, and who has the right experience to handle your case. We believe that negotiation and mediation are the best options but when those options have been exhausted, you must be prepared to implement legal strategies to protect the interests of the client. We have an excellent business litigation team prepared to fight and win your case.

We work according to the following methodology:

  • Phase 1: Study of the case: Once we have all the relevant information, we will study the case to determine the best legal position. We examine the correct identification of the other party, the tracing of its location and a preliminary solvency assessment.
  • Phase 2: Pre-court negotiations: Our primary goal is to find an amicable solution and reduce time and costs for the client. Our service includes negotiation and drafting of the settlement (if necessary).
  • Phase 3: Court: If the other party holds a position that prevents mediation, we will make our recommendations on whether it is worthwhile to file a claim or not. If so, we make an intensive legal study of the case, examining and reviewing all the documents and evidence needed. We proceed to present the case before the competent Spanish court and manage all the issues that might arise before the court. Once the sentence is imposed, we perform enforcement proceedings, if necessary.

Our rates are tailored to the circumstances of each case. Please contact us and briefly describe the case, then we will prepare a proposal of services that best suits your needs.

Is it necessary to hire a lawyer for a lawsuit in Spain?

When a case is for an amount over 2000€, it is mandatory to be represented by a procurador, and to be assisted by a lawyer to defend you in court. For a case under 2000€, it is still recommended to use these professionals for better protection of your rights.
